These Terms of Service (the “Terms”) form a binding agreement between you and Eandeals VOF, trading as EventLens.ai, established at Herengracht 320, 1016 CE Amsterdam, the Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 73198153 (“EventLens”, “we”, “us”, “our”). They govern your access to and use of our website eventlens.ai, our applications, and our event photo, video and audio sharing service (together, the “Service”). By creating an account, purchasing a plan, or uploading or accessing any content through the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Definitions

Host means the account holder who creates an event album. Guest means any person who uploads to or views an event album via a link or QR code. User Content means any photo, video, audio message, caption or other material uploaded to the Service. You means the Host or Guest using the Service.

2. Eligibility and age

You must be at least 18 years old, or the age of majority in your country, to create an account. Guests under the age of 16 may only use the Service with the consent of a parent or legal guardian. You are responsible for ensuring that everyone you invite to an event is permitted to use the Service.

3. Your account

You must provide accurate and complete information and keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use. We may refuse, suspend or cancel accounts at our reasonable discretion.

4. The Service and changes to it

EventLens lets Hosts create private event albums where Guests can upload and view photos, videos and voice messages, typically via a QR code or shared link, with optional features such as live slideshows, media albums, voicemail (audio guestbook) and FaceAI. We continuously develop the Service and may add, change, suspend or remove features at any time. We may also set technical limits, such as file sizes, upload counts and storage periods, which vary by plan.

5. Plans, prices and payment

We offer a free plan and paid plans, including one-time purchases, as described at checkout and on our Pricing page. Prices are shown in the applicable currency and may exclude taxes, which are added where required. Payment is processed by third-party payment providers; by paying you also agree to their terms. All fees are due at the time of purchase. Except where these Terms or mandatory law provide otherwise, payments are non-refundable, and you agree not to initiate unwarranted chargebacks.

6. Money-back guarantee and refunds

Where we advertise a money-back guarantee, we will honour it in accordance with the terms stated at the point of purchase. To request a refund under the guarantee, contact us at [email protected] within the stated period. We may decline refunds in cases of abuse, fraud, or breach of these Terms. This does not affect any statutory refund rights you may have as a consumer.

7. Right of withdrawal (consumers)

If you are a consumer in the EU, you may have a statutory right to withdraw from a purchase of digital services within 14 days. You expressly request that the Service begins during this period and acknowledge that, once the Service has been fully performed or you have started using paid digital content, your right of withdrawal may lapse to the extent permitted by law.

8. Your content and the licence you grant us

You and your Guests retain ownership of your User Content. You grant EventLens a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, adapt (for example to create thumbnails, format conversions and previews), transmit and display User Content solely to operate, provide, secure and improve the Service and as instructed by the Host. This licence ends when the User Content is deleted from the Service, except for copies retained in routine backups for a limited period or as required by law.

9. Your responsibilities and warranties regarding content

You represent and warrant that you own or have all necessary rights, licences and consents to upload and share your User Content and to grant the licence above, and that your User Content and its use through the Service do not infringe or violate the rights of any third party (including intellectual property, privacy, publicity and data-protection rights) or any law. As a Host, you are responsible for informing your Guests and any individuals appearing in User Content about how their images, videos and voices are collected and used, and for obtaining any consent required by law.

10. Privacy and data protection roles

For personal data contained in User Content within an event album, the Host acts as the data controller and EventLens acts as the data processor, processing such data on the Host’s behalf and instructions. The Host is responsible for having a valid legal basis for collecting and sharing that data. Our handling of personal data is described in our Privacy Policy. Where required, a data processing agreement applies.

11. FaceAI and biometric features

The FaceAI feature can detect and group faces in uploaded media. Depending on how it is used and your jurisdiction, this may involve biometric or otherwise sensitive personal data subject to stricter legal requirements. If you enable FaceAI, you are responsible for determining whether it is lawful for your event, for providing any required notices, and for obtaining any explicit consent required from the individuals concerned before their media is processed. You must not use FaceAI for unlawful identification, surveillance, profiling or any purpose prohibited by law. You are solely responsible for your use of this feature.

12. Acceptable use

You agree not to use the Service to: (a) upload or share content that is unlawful, infringing, defamatory, harassing, hateful, obscene or harmful; (b) upload sexual content involving minors, which is strictly and absolutely prohibited and will be reported to the authorities; (c) violate the privacy, data-protection or publicity rights of others; (d) upload malware or attempt to gain unauthorised access to, disrupt, overload, reverse engineer or circumvent the security of the Service; (e) use the Service for spam, fraud or any illegal activity; or (f) resell or commercially exploit the Service without our written permission. We may remove content and suspend accounts that breach this section.

13. Reporting and takedown

If you believe content on the Service infringes your rights or is unlawful, contact us at [email protected] with sufficient detail to identify the content. We will review reports and may remove content or disable access at our discretion, without this constituting an admission of liability.

14. Our intellectual property

The Service, including our software, design, branding, logos, text and other materials (excluding User Content), is owned by EventLens or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose. All rights not expressly granted are reserved. You may not copy, modify, distribute, or create derivative works of the Service except as permitted by law.

15. Feedback

If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free licence to use them without restriction or obligation to you.

16. Third-party services

The Service may integrate with or link to third-party services (such as payment providers, hosting and analytics). We are not responsible for third-party services, and your use of them is subject to their own terms.

17. Availability, backups and disclaimer of warranties

We aim to provide a reliable Service but do not guarantee that it will be uninterrupted, timely, secure, error-free, or that content will always be available or preserved. To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability and non-infringement. You are responsible for keeping your own copies of important content.

18. Limitation of liability

To the maximum extent permitted by law, EventLens and its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or content, however caused. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms is limited to the amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim, or fifty euros (€50) if you paid nothing. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intent or gross negligence, or the mandatory rights of consumers.

19. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend and hold harmless EventLens and its owners, employees and suppliers from and against any claims, damages, liabilities, losses and costs (including reasonable legal fees) arising out of or related to your User Content, your use of the Service, your breach of these Terms, your use of FaceAI, or your violation of any law or third-party rights. This clause does not apply to the extent a claim results from our own intent or gross negligence, and does not limit the mandatory rights of consumers.

20. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your access, remove content, or close your account if you breach these Terms, if required by law, or to protect the Service, other users or third parties. On termination, your right to use the Service ends immediately.

21. Data retention after termination

After an account or event ends, or after the storage period for your plan expires, we may delete your User Content and account data in accordance with our Privacy Policy and applicable law. It is your responsibility to download and back up any content you wish to keep before it is deleted.

22. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including internet or hosting failures, power outages, cyber-attacks, strikes, natural disasters or acts of government.

23. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page with a new date and, where changes are material, take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

24. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations, for example in connection with a merger, acquisition or sale of assets.

25. Governing law and disputes

These Terms are governed by the laws of the Netherlands. Any disputes will be submitted to the competent court in Amsterdam, unless mandatory law grants you, as a consumer, the right to bring proceedings in another court. Consumers may also use the European Commission’s Online Dispute Resolution platform.

26. Miscellaneous

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect and the invalid provision will be replaced by a valid one that most closely reflects its intent. Our failure to enforce any right is not a waiver. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and EventLens regarding the Service. In case of conflict between translations, the English version prevails.
